General Terms and Conditions (GTC) – Rental of Finca Cala Panizo

§ 3 Rental Property
The landlord, Johanna Koerner, rents Finca Cala Panizo to the tenant for residential purposes at Calle Acebuche 7, 04648 Cuevas del Almanzora, Cala Panizo, Spain. The rental property includes 1 living room, 1 kitchen, 4–5 bedrooms, 3–4 bathrooms with showers, the main patio, terrace, pool, garden, and the sports area. The living area totals 350 m². The rental includes use of the swimming pool, the large terrace with furniture, and the garden. The adjacent tower apartment is only included in the rental if specifically booked. The property is fully equipped and furnished. An inventory list and all necessary keys are provided upon arrival.
§ 4 Rental Period
1. The rental period is agreed upon individually. 2. The landlord provides the rental property to the tenant from 3:00 PM on the day of arrival. 3. On the day of departure, the property must be vacated completely and cleaned by 10:00 AM at the latest. All keys must be returned to the landlord. Extensions are possible by arrangement.
§ 5 Rental Price and Payment Terms
The rental price depends on the season and the length of stay. The price includes bed linen, towels, electricity (provided that costs do not exceed €500 during the rental period), water and gas, as well as internet and Wi-Fi usage. Telephone charges are not included. Payment is made in two installments via bank transfer.
§ 6 Deposit
At the start of the rental period, a security deposit of €500 is collected to cover any potential damage or excessive soiling. The deposit will be refunded after the end of the rental period, provided the property is returned in proper condition and there are no outstanding claims. The refund will be made within 14 days after departure to the tenant’s bank account.
§ 7 Cancellation / Withdrawal
1. The rental agreement can be canceled up to 90 days before arrival. In this case, any deposits already paid will be refunded in full, and you may withdraw from the contract free of charge. 2. For cancellations less than 90 days before the planned arrival, the full rental price is due. 3. In the event of official travel restrictions or health advisories that prevent international travel, the reservation may be canceled without any cancellation fees. 4. Any termination or cancellation must be made in writing. The date the cancellation letter is received by the landlord is considered the official date. 5. If the tenant is more than 8 days late with payment, the landlord is entitled to terminate the contract without further notice and rent the property to another party. In this case, any deposits already paid will not be refunded.
§ 8 Tenant’s Obligations / House Rules
The tenant agrees to: - Treat the finca and its inventory with care, - Comply with the house rules, - Report any damage or defects immediately. The maximum number of guests may only be exceeded by prior agreement. Pets are only allowed with prior arrangement and the explicit consent of the landlord. Subletting or commercial use of the property is not permitted.
§ 9 Maintenance of the Rental Property and Liability
1. The tenant agrees to handle the property, swimming pool, and shared facilities and furniture with care. Any damage must be reported to the landlord immediately. In case of delayed reporting, the tenant is liable for consequential damages. 2. The tenant is responsible for the cleanliness of the property. Failure to maintain cleanliness renders the tenant liable for any resulting damages. 3. The tenant is liable for damages resulting from negligent breaches of duty. It is the tenant’s responsibility to prove that no negligence occurred. 4. The tenant is also liable for damages caused by their family members, guests, or any other persons invited or supervised by the tenant.
